1. MEDICAL DISCLAIMER

1.1 NOT A MEDICAL DEVICE

The App provides informational analysis of skincare and cosmetic product ingredients based on general allergen databases and user-provided sensitivity information. This information is intended for general educational and informational purposes only.

1.2 NO DOCTOR-PATIENT RELATIONSHIP

Use of the App does not create a doctor-patient, healthcare provider-patient, or any other professional-client relationship between you and MySkinIQ.

1.3 CONSULT HEALTHCARE PROFESSIONALS

ALWAYS CONSULT A QUALIFIED DERMATOLOGIST, ALLERGIST, OR OTHER HEALTHCARE PROFESSIONAL:

• Before using any new skincare or cosmetic product
• If you experience an allergic reaction or adverse skin reaction
• For diagnosis and treatment of skin conditions, allergies, or sensitivities
• Before relying on any information provided by the App

1.4 LIMITATIONS OF ALLERGEN DETECTION

The App's allergen detection capabilities are limited by:

• The accuracy of our allergen database (which may not include all known allergens)
• The accuracy of product ingredient information (which may be incomplete, outdated, or incorrect)
• Variations in individual sensitivity and reaction thresholds
• Cross-contamination during manufacturing not reflected in ingredient lists
• Fragrance and flavor compositions that may contain undisclosed allergens
• Regional formulation differences for the same product

1.5 EMERGENCY SITUATIONS

IF YOU EXPERIENCE A SEVERE ALLERGIC REACTION (ANAPHYLAXIS), DIFFICULTY BREATHING, OR OTHER MEDICAL EMERGENCY, CALL EMERGENCY SERVICES (911 IN THE US) IMMEDIATELY. DO NOT RELY ON THIS APP IN MEDICAL EMERGENCIES.

2. ARTIFICIAL INTELLIGENCE DISCLOSURE

2.1 AI-Powered Analysis

The App uses artificial intelligence and machine learning technologies, including large language models and natural language processing, to analyze product ingredients and provide safety assessments. Specifically:

• Ingredient Parsing: AI systems interpret and categorize ingredient lists from product labels and databases
• Allergen Matching: Machine learning algorithms identify potential allergen matches and cross-reactivity patterns
• Safety Verdicts: AI models generate product safety classifications based on your allergen profile
• Alternative Recommendations: AI suggests substitute products based on ingredient similarity analysis

2.2 AI Limitations

YOU ACKNOWLEDGE AND UNDERSTAND THAT:

• AI-generated analyses may contain errors, inaccuracies, or omissions
• AI systems may not account for all individual variations in sensitivity or reaction patterns
• AI models are trained on historical data and may not reflect the most recent scientific research
• AI cannot detect allergens not disclosed in ingredient lists or resulting from manufacturing cross-contamination
• AI recommendations should not be relied upon as the sole basis for skincare decisions

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 13 years of age to use the App. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the App with the consent of a parent or legal guardian who agrees to be bound by these Terms.

3.2 Account Creation

To access certain features, you must create an account using Apple Sign-In or Google Sign-In. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Description of Service

4.1 What MySkinIQ Does

The App provides:

• Product Analysis: AI-powered analysis of skincare and cosmetic product ingredients to identify potential allergens based on your personal allergen profile
• Safety Verdicts: Classification of products as Safe, Caution, or High Risk based on your allergen profile
• Allergen Discovery: Guided trial system to help identify potential allergen sensitivities
• Safer Alternatives: Recommendations for alternative products that avoid your identified allergens
• Cross-Reactivity Warnings: Alerts about chemically related allergens

4.2 Data Sources

Our allergen analysis is informed by:

• Proprietary allergen database (157+ allergens, 57 allergen families)
• Clinical research from the North American Contact Dermatitis Group (NACDG)
• American Contact Dermatitis Society (ACDS) publications
• EU Cosmetics Regulation (EC) No 1223/2009
• Peer-reviewed dermatological research

5. Subscription Terms

5.1 Free and Paid Tiers

5.2 Free Trial

New Pro subscribers may be eligible for a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

5.3 Billing and Payment

• All payments are processed through Apple's App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings

5.4 Price Changes

We may change subscription prices from time to time. We will provide at least thirty (30) days' advance notice of any price increase via email and/or through a prominent notice in the App.

5.5 Refunds

Refund requests are handled by Apple in accordance with their App Store policies. To request a refund, visit Apple's Report a Problem page.

6. User Responsibilities

6.1 Accurate Information

You agree to:

• Provide accurate allergen and sensitivity information to receive appropriate analysis
• Update your allergen profile as your known sensitivities change
• Not rely solely on the App for allergy management

6.2 Prohibited Conduct

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated systems (bots, scrapers) to access the App
• Submit false or misleading product discrepancy reports

7. Intellectual Property

The App and its contents, including but not limited to software code, allergen database, user interface design, and trademarks, are owned by MySkinIQ LLC or our licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal device solely for your personal, non-commercial use.

8. Privacy and Data Rights

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You have the right to:

• Access: Request a copy of your personal data
• Correction: Request correction of inaccurate data
• Deletion: Request deletion of your account and data
• Data Portability: Export your data in a machine-readable format (JSON)

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR COMPLETENESS OF INFORMATION.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYSKINIQ LLC BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from allergic reactions or adverse health effects
• Damages resulting from reliance on information provided by the App

9.3 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR

(B) ONE HUNDRED DOLLARS ($100).

10. Dispute Resolution

10.1 Informal Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@myskiniq.shop. We will attempt to resolve the dispute within 30 days.

10.2 Binding Arbitration

IF WE CANNOT RESOLVE A DISPUTE INFORMALLY, YOU AND MYSKINIQ AGREE TO RESOLVE ANY DISPUTES THROUGH BINDING ARBITRATION RATHER THAN IN COURT, except that either party may bring claims in small claims court if eligible.

10.3 Class Action Waiver

YOU AND MYSKINIQ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

10.4 Opt-Out

You may opt out of arbitration by sending written notice to legal@myskiniq.shop within 30 days of first accepting these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12. Term and Termination

These Terms are effective until terminated by you or us.

You may terminate by deleting your account through Settings > Delete Account or by uninstalling the App.

We may terminate for material breaches immediately. For non-material breaches capable of cure, we will provide written notice and 14 days to cure the breach.

13. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide notice through email notification and/or a prominent notice in the App.

Your continued use of the App after changes constitutes acceptance of the modified Terms.

BY USING THE APP, YOU ACKNOWLEDGE THAT:

4. You understand that MySkinIQ is NOT a medical device
5. You understand that MySkinIQ uses AI for ingredient analysis, which has limitations
6. You will consult healthcare professionals for medical advice
7. You are at least 13 years of age (or have parental consent)
